Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Flock mobile application, website, and related services ("Flock", "we", "our"). By creating an account, joining a Flock, or using Flock as a guest, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use Flock. If you are under the age of majority in your region, you must have consent from a parent or legal guardian.
2. Accounts & Guest Access
Users may participate as:
- Guests: limited access; no chat or administrative privileges.
- Registered Users: full access according to their role within the Flock.
You are responsible for maintaining the confidentiality of your login credentials. Activities performed using your account are your responsibility.
3. Flock Membership & Roles
Users may join or be added to group spaces ("Flocks"). Each Flock may assign different roles (member, co-organizer, organizer). Organizers may modify Flock content, manage membership, and assign tasks.
We are not responsible for actions taken by other members of a Flock, including changes made to trips, tasks, or group data.
4. User Content
You may upload or submit information such as trip details, links, notes, preferences, images, or profile data ("User Content"). You grant Flock a non-exclusive, worldwide, royalty-free license to use, store, display, and modify this content solely to operate the service.
You are responsible for ensuring your content does not violate any intellectual property rights, privacy rights, or laws.
5. Prohibited Conduct
You agree not to:
- Use Flock for unlawful purposes.
- Harass, abuse, or impersonate others.
- Upload harmful code or attempt to bypass security features.
- Use automated tools to scrape or disrupt the service.
- Misuse trip or member data.
Violation may result in suspension or termination of access.
6. Payments & Subscriptions
Flock offers optional auto-renewable subscriptions. Payment will be charged to your selected payment method through the Apple App Store or Google Play Store, depending on your device.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription at any time through your Apple ID or Google Play account settings.
Subscription fees are non-refundable except as required by law. Pricing may change with reasonable notice.
7. Service Availability
Flock is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability. We may modify, suspend, or discontinue portions of the service at any time.
8. Third-Party Services
Flock may link to third-party content (Airbnb, Booking, etc.). We are not responsible for the availability, accuracy, or practices of these external sites.
9. Limitation of Liability
To the fullest extent permitted by law:
- Flock is not liable for indirect, incidental, or consequential damages.
- Our total liability will not exceed the amount paid by you in the past 12 months, or $0 for free/guest users.
10. Indemnification
You agree to indemnify and hold Flock harmless from claims arising from your misuse of the service or violation of these Terms.
11. Termination
We may suspend or terminate your access at any time for violations of these Terms. You may stop using Flock at any time by deleting your account.
12. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance.

Apple App Store Terms
If you downloaded Flock from the Apple App Store, your use of the app is also subject to Apple's Standard End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
In the event of a conflict between Apple's Standard EULA and these Terms, Apple's Standard EULA shall govern.
